PRELIMINARY TITLE

 

The company VIPEALO, S.L., is the Owner of the WINE GOGH school. The objective of the Internal Regime Regulation is to serve as a common framework in which to establish good relations between the parties that participate in the development of the school’s training service. The Internal Regime Regulation is an internal standard that includes principles, rights, duties and behavioral conduct, whose purpose is to regulate the organization of the school, the rules of coexistence and the procedures for the resolution of conflicts.

 

 

LEGISLATION

 

The current regulations on which this Regulation is based are the following:

The organization and operation of the school will respond to the following principles:

 

  1. a)The full realization of the school’s training offer.
  2. b)Promoting quality in training.

 

The training provided by the school and chosen by the students is carried out in accordance with the school’s values, condensed into two driving principles:

 

First principle.- Enhance the individual skills of the students.

 

Second principle.- Prepare students to be able to improve their techniques and knowledge to become professionals.

 

 

 

TITLE I

COMMUNITY TRAINING

 

Art. 3Members.

 

  1. The school’s training community comprises a group of people involved in the training action, who share and enrich the school’s objectives.
  2. The functions and responsibilities of the members of the training community (owner entity, students, teachers, and other collaborators) are diverse due to their contribution to the common project.

 

Art. 4. Rights.

 

Members of the training community have the right to:

 

 

  1. a)Be respected in their rights, integrity and personal dignity.
  2. b)Know the training project and the Internal Regime Regulations of the school.
  3. c)Participate in the operation and life of the school, in accordance with the provisions of these Regulations.
  4. d)Exercise those other rights recognized in the laws, in the school and in these Regulations.

 

 

Art. 5. Duties.

 

Members of the training community are obliged to:

 

  1. a)Accept and respect the rights of the owner entity, the students, the teachers, and the collaborators of the training community.
  2. b)Respect the training project, these Regulations, the rules of coexistence and other rules of organization and operation of the school, as well as the instructions or training guidelines of teachers and collaborators.
  3. c)Respect the right to privacy, honor, self-image and health of all members of the training community.
  4. d)Observe the rules on protection and processing of personal data in accordance with the provisions of Organic Law 3/2018, of 5 December, Protection of Personal Data and guarantee of digital rights and other applicable regulations.

 

 

Art. 6. Protection against violence and creation of a safe environment for underage students.

 

According to Organic Law 8/2021, of June 4, on comprehensive protection of children and adolescents against violence, the WINE GOGH Training Center is a safe space for minors. Where the rights of children are respected, with protection against all intimidation, discrimination and situations of violence or bullying; promoting the adoption and monitoring of educational measures that promote the recognition and protection of the rights of minors.

 

In those situations that may involve illicit processing of personal data of minors, immediate communication from the Training Center to the Spanish Data Protection Agency will be promoted.

 

In addition, it is mandatory that the Teaching Staff and Collaborators have accreditation of the negative certificate from the Central Registry of Sexual Offenders and Trafficking in Human Beings, and that they have not been convicted of crimes against sexual freedom or indemnity or trafficking. of human beings.

 

 Art. 7. Inspiring principles and rules of coexistence.

 

  1. The school’s coexistence rules are inspired by the following basic principles to promote:

 

  1. a)The project training
  2. b)A good atmosphere in the school during the training provided.
  3. c)Respect for the rights of all people who participate in the training action.

 

  1. Without prejudice to those established in this Regulation, the school’s rules of coexistence are:

 

  1. a)Respect for the physical and moral integrity and property of the people who make up the training community and those other people and institutions that relate to the school on the occasion of carrying out activities and services therein.
  2. b)Correctness in social treatment and the use of correct and appropriate language.
  3. c)Respect and responsible development of the different functions of the members of the training community.
  4. d)Cooperation in training or coexistence activities.
  5. e)Good faith during the provision of the training service.
  6. f)The positive attitude towards notices and corrections.
  7. g)Respect for the rules of organization, coexistence and discipline of the school.
  8. h)In general, compliance with the duties indicated in current legislation and in this Regulation by the members of the training community and each of its entities, especially the school’s training project.

 

 

 

CHAPTER ONE: OWNER ENTITY/COMPANY

                                               

Art. 8. Rights.

 

The owner entity/company has the right to:

 

  1. a)Guarantee their respect and boost their effectiveness.
  2. b)Establish the school’s training project and the coexistence plan, as well as the other plans established in the state training regulations.
  3. c)Direct the school, hold its representation and ultimately assume responsibility for its organization and management.
  4. d)Order the economic management of the school.
  5. e)Decide the provision of activities and services.
  6. f)Select, hire, appoint and dismiss school personnel.
  7. g)Design teacher training processes and their evaluation.
  8. h)Establish, within the provisions in force, the right of admission of students to the school, as well as their dismissal.
  9. i)Have the initiative in correcting alterations in coexistence.
  10. j)Develop and specify the rules of coexistence within the framework of what is provided by state legislation.
  11. k)And all those Rights that current regulations allow.

 

 

Art. 9. Duties.

 

The owner entity is obliged to:

 

  1. a)Provide training in accordance with the school’s training project and the quality standards established in this Regulation.
  2. b)Promote respect for others during the delivery of training.
  3. c)Make known the training project and the Internal Regime Regulations of the school.
  4. d)Be responsible for the operation and management of the school before the training community and society.

 

 

 

 

CHAPTER TWO: STUDENTS.

 

Art. 10. Rights.

 

Students have the right to:

 

  1. a)The objective assessment and recognition of your dedication, effort and performance.
  2. b)Receive training guidance. 
  3. c)Express their opinions freely, respecting the rights and reputations of other people, within the framework of the school’s rules of coexistence.
  4. d)Participate, in the terms provided in current regulations and in this document, in decision-making that affects them.

 

 

 

 

Art.11. Duties.

 

The students are obliged to:

 

  1. a)Strive to achieve maximum development according to their abilities and participate in training activities aimed at developing curricula.
  2. b)Follow the guidelines of teachers and collaborators regarding their training and learning.
  3. c)Respect the authority and guidelines of the teachers and collaborators of the training community.
  4. d)Attend class punctually and comply with the school’s schedule and training calendar.
  5. e)Participate and collaborate in improving coexistence and achieving an adequate study climate at school.
  6. f)Respect the right of the rest of the students to training.
  7. g)Comply with these Internal Regulations and respect the rules of organization, coexistence and discipline of the school.
  8. h)Maintain and make good use of the school’s facilities and teaching materials
  9. i)The proper use of the building, furniture, facilities, in accordance with its purpose and operating rules, as well as respect for the reservation of access to certain areas of the school. The school will provide the basic materials for each subject; it is the obligation of each student to maintain and conserve their own materials, according to their proper use. In the present document, Annex I details the list of materials that WINE GOGH provides to the student..
  10. j)Those other duties determined in this Regulation and current regulations.
  11. k)The classes in WINE GOGH They are in person and attendance is mandatory, absence is not allowed except with a medical or work certificate.
  12. l) Delays will not be allowed in the classrooms, after the first 5 minutes, no student will enter class.
  13. m)The student yields, in this act, to WINE GOGH, all the rights that may correspond to any type of work that can be protected by copyright, be it text, image, or any other type of creation protect-able by Intellectual Property, which has been made within the scope of compliance with the object of this Agreement or through the school’s means WINE GOGH, as well as those that could be used in some way by the school carried out during academic hours, or outside of them, with resources from WINE GOGH.

 

 

 

 

Legal representative/payer other than the student

 

If a person other than the student makes the payment corresponding to the monthly tuition fees to the school WINE GOGH, will be deprived of any action regarding the monitoring of the student’s training. The legal representative/payer other than the student has the sole obligation and duty to make the monthly payment itself. The rights and obligations of training, learning and monitoring of the courses taught in WINE GOGH, to the student enrolled in it.

 

 

Art. 13. Admission

 

  1. The right of admission of students is the responsibility of the entity that owns the school.

 

CHAPTER THREE. TEACHERS.

 

Both the rights and duties of the teaching staff will comply with the provisions of the applicable collective agreement, in addition to what is reflected in this Regulation.

 

 

 

Art. 14. Rights

 

Teachers have the right to:

 

  1. a)Freely carry out their training function in accordance with the characteristics of the position they occupy, the curriculum and the training proposal of the school.
  2. b)Participate in the preparation of programming, if the owner entity so deems it.
  3. c)Develop your methodology in accordance with the programming and what is established by the title entity.
  4. d)Use the material resources and facilities of the school for training purposes, in accordance with the rules governing their use.
  5. e)Enjoy the presumption of truthfulness in those cases in which the alteration of coexistence occurs between a member of the teaching staff and a student, and this without prejudice to the evidence that the student could provide in order to refute said presumption and assert, in this way, their rights or interests.

 

 

Art. 15. Duties.

 

  1. Teachers are obliged to:

 

  1. a)Perform their functions in accordance with current legislation, the conditions stipulated in their contract and the guidelines of the title entity.
  2. b)Cooperate in meeting the objectives of the school’s training project, and follow the guidelines established in the programs in the performance of their duties.
  3. c)Participate in the development of the specific programming of the area or subject taught, within the training team del curso específico correspondiente.
  4. d)Evaluate the student learning process.
  5. e)The tutoring of students, the direction and orientation of their learning in all aspects of their training.
  6. f)Collaborate in maintaining order and discipline within the exercise of their duties, in accordance with the school’s coexistence plan and promoting respect.
  7. g)Maintain professional confidentiality of all information you have access to due to your condition and job position.
  8. h)Comply with the instructions provided by the owner entity regarding the protection of personal data in the exercise of their functions.
  9. i)Respect the right to the image of students and comply with the regulations in this regard.

 

 

CHAPTER FOUR. OTHER MEMBERS OF THE TRAINING COMMUNITY

 

Art. 16. Collaborators.

 

Collaborators who participate through a service provision contract may be part of the training community, in accordance with what is determined by the entity that owns the school.

 

Art. 17. Rights

 

Exercise their functions in the terms established in their service provision contract, by the legislation that applies to them and by the entity that owns the school.

 

 

Art.18. Duties.

  1. a)Do not interfere with the normal development of school activities.

TITLE II

FORMATIVE ACTION

 

Art. 19. Principles.

 

  1. The school’s training action is articulated around the applicable legislation, the characteristics of its agents and recipients, the school’s resources and the environment in which it is located.

 

  1. The members of the training community are the protagonists of the school’s training action.

 

  1. Integrates and interrelates academic and training aspects.

                                                                          

 

Art. 20. School Training Project.

 

The ownership representative, is the competent body to direct and coordinate the preparation, execution and evaluation of the training project.

 

The degree of achievement of the training project will be an indicator of the level of quality of the offer made by the school.

Art. 21. Training program and duration

 

The training program is made up of three training course offerings; of reduced time, which can be group or individual in nature, and a third offer of training course, with a monthly period, with seminars and events developed by the school or by other collaborating entities.

All courses are face-to-face.

 

In the three training offers, the student will be able to develop different uses and singularities in learning painting, with the following:

 

  1. – Acrylic with Pouring technique.
  2. – Acrylic with Decoupage projectors.
  3. – Watercolor.
  4. – Lettering.
  5. – Drawing.
  6. – Mosaic workshop.
  7. – Makeup workshop (facepainting, bodypainting)
  8. – Ceramic workshop.

 

 

 

Art. 22. Evaluation and monitoring.

 

The evaluation of the training action is the instrument for verifying compliance with the school’s objectives and the basis for adopting the corrections that are pertinent to better achieve its goals. The entire training community will participate. The title entity directs its preparation and execution.

 

Each student will receive their grade, in order to order the abilities in each course.

 

At the end of the training course, the student will receive, according to his or her qualification and the teacher’s criteria, a diploma that accredits its completion.

 

The diploma will be sent to the student, to their email.

 

 

 

Art. 23.- Intellectual Property

 

The student yields, in this act, to WINE GOGH, all the rights that may correspond to it on any type of work that can be protected by copyright, be it text, image, or any other type of creation protectable by Intellectual Property, that has been made within the scope of compliance of the object of this Agreement or through the means of the WINE GOGH school, as well as those that could be used in some way by the school carried out during academic hours, or outside of them, with WINE GOGH resources.

This transfer is made for the maximum period permitted by law and for a global territorial scope, and includes all the exploitation modalities that currently exist – in particular the rights of distribution, public communication, transformation and reproduction – as well as any other future modalities. that may exist. Furthermore, this transfer includes all uses that the works or parts thereof may have, using the technical means currently known and those that may be developed in the future and for any application.

 

TITLE III

 

ALTERATION OF COEXISTENCE

 

Art. 24.- General disposition

Coexistence at school is regulated by what is specified herein Reglamento de Régimen Interior.

 

Art. 25. – Alteration of coexistence

Alterations to coexistence may consist of conduct contrary to it or seriously harmful conduct.

 

Art 26.- Conduct contrary to coexistence and/or seriously harmful.

 

  1. a)Unjustified absences.
  2. b)Unjustified lack of punctuality.
  3. c)Acts that alter the normal development of school activities, especially classes.
  4. d)Acts of indiscipline.
  5. e)Acts of incorrectness, inconsideration, insults and offenses against any member of the Training Community.
  6. f)The theft or intentional deterioration of property, materials, documentation or resources of both the school and any member of the Training Community.
  7. g)Actions detrimental to the integrity and health of any member of the Training Community.
  8. h)The systematic refusal to bring the material necessary for the development of the teaching-learning process.
  9. i)The incitement to commit an offense contrary to the rules of coexistence.
  10. j)Inappropriate use of school infrastructure and property or equipment.
  11. k)Disobedience in compliance with school rules that are included in the training project.
  12. l)Physical aggression, threats and coercion, serious discrimination and lack of respect for the integrity or personal dignity of any member of the Training Community.
  13. m)The humiliation and humiliation of any member of the Training Community, especially if they have a sexist or xenophobic component, as well as those carried out against the most vulnerable students due to their personal, social or educational characteristics.
  14. n)

ñ) Personality impersonation in acts of teaching life.

  1. o)The falsification, deterioration or theft of academic documentation.
  2. p)The introduction into the school of dangerous objects or substances harmful to the health and personal integrity of any member of the Training Community.
  3. q)The incitement or encouragement to commit an offense that seriously affects coexistence at school.
  4. r)The repeated refusal to comply with the corrective measures adopted.

 

Art. 27. Contract termination

Conduct contrary to coexistence and/or seriously harmful will entail:

  1. a)Unilateral termination of the contract and expulsion from school.

Art. 28. FEES

 

  1. a)For the proper functioning of the school, the fees are a single payment, made before the start of the course. Through Bank Card and/or Bank Transfer 

 

 

  1. b)In case of non-payment, the school will deny access to it and will charge a surcharge of 20 EUROS per returned or unpaid fee (optional).
  2. c)To withdraw, you must notify the school two weeks in advance.
